Wal-Mart recalls frozen chicken nuggets

by Administrator 22. July 2010 04:51

Wal-Mart and the U.S. Department of Agriculture's Food Safety and Inspection Service announced earlier this week the recall of Perdue Farms, Inc.'s "Great Value Fully Cooked Chicken Nuggets".  Perdue Farms became suspicious of their product after receiving several complaints from consumers that they found small pieces of blue plastic in their chicken nuggets.

91,872 pounds of the product have been recalled and removed from Wal-Mart shelves across the country.  The affected product is in 1 pound 13 ounce bags and has a use-by date of June 9th, 2011.  Officials recommend that if you believe you have already purchased the affected product to refrain from consuming it.

Diving company fined by OSHA

by Administrator 10. June 2010 05:50

Scuba Clean Inc., a St. Petersburg, has incurred a large sum of fines after failing to follow safety protocols.

The current charges against the company include a $200,900 fine that combines failures to provide sufficient safety equipment for divers, a failure to properly train divers before sending them into the water, and a failure to keep employees with divers on their dives to make sure that they are safe. According to the U.S. Department of Labor's Occupational Safety and Health Administration, the company was willfully negligent in upkeeping its practices and equipment. To the deparment's definition, willful violators can be simply indifferent to changing after being warned of safety problems. Unless they work to change charges and violations, the violator is considered willful.

These circumstances has caused the administration to tally up Scuba Clean's 16 major hazards for a $53,900 fine in addition to the three citations of willful violations, which account for $147,000 of the total fine.

If you or someone you love has been injured while using another company's products, you may be eligible for compensation. Contact the Tampa product liability lawyers at Beltz & Ruth, P.A., by calling 800-235-8978 today.

Covidien Recalls Potentially Dangerous Tracheostomy Tubes

by Administrator 25. May 2010 09:16
In a recent FDA press release, Covidien initiated a voluntary recall of certain lots of tracheostomy tubes.  The seal could be compromised resulting in serious injury, including death.  The Massachusetts company received reports of three people dying while using their tracheostomy tube.  The detailed information needed to determine what role the device may have played in these deaths is still being uncovered.

Tracheostomy tubes, commonly referred to as "trach tubes", are placed in a patient's neck ti open a direct airway through an incision in the trachea (windpipe) to help them breathe.  This is often done when the patient cannot breathe on their own.
Only Shiley tracheostomy tubes from lot numbers listed in the company's press release are affected by this recall.  The voluntary recall only affects lot numbers from a specific period of time.

by Administrator 8. December 2009 06:39

While many of these accidents occur at the fault of the skiers, some occur because of defects in skiing equipment. These defects can occur in skis, boots, or even snowboards. When accidents occur due to these defects, the equipment manufacturer or distributor may be liable for damages.

FDA Issues Warning on Zicam Nasal Cold Remedy Side Effects

by Administrator 18. June 2009 00:53
HAVE YOU USED ZICAM NASAL COLD REMEDY?  HAVE YOU LOST YOUR SENSE OF SMELL?
YOU MAY BE ENTITLED TO COMPENSATION!

The Food and Drug Administration issued a public advisory on June 16, 2009, warning the public about the risks associated with the use of some Zicam Nasal Cold Remedies. Specifically, the FDA issued a warning that users could lose their sense of smell.  The condition, known as anosmia, can be temporary or permanent, and leave lasting effects on the injured. Even one time usage of the Zicam Cold Remedy products can result in a loss of your sense of smell.

Those Zicam products identified by the FDA include:
  • Zicam Cold Remedy Nasal Gel
  • Zicam Cold Remedy Nasal Swabs
  • Zicam Cold Remedy Swabs Kids Size*
*Swabs Kids Size are no longer sold in stores but consumers may have some in their household.  These were actually discontinued before the FDA warning was issued but still pose a threat to children and should not be given to children.

Loss of smell affects your ability to taste, resulting in less enjoyment with eating. The quality of life is also affected by the inability to enjoy pleasant aromas.   Your safety is at risk with a loss of the sense of smell as you may not sense smoke, or other dangers.

If you or a loved one has lost the sense of smell after using Zicam Cold Remedies, you may be entitled to compensation from the drug manufacturer for your medical expenses, lost income, pain, suffering and the loss of your quality of life.   For a free, confidential consultation of your legal rights, contact the Tampa Zicam lawyers of Beltz & Ruth, P.A at 800-235-8978.
